Terms of Service

Welcome to Forma. These Terms of Service ("Terms") govern your access to and use of the Forma mobile application (the "App"), website, and related services (collectively, the "Service"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & Account Registration

• You must be at least 13 years old to use Forma (or the age of digital consent in your jurisdiction)
• By using Forma, you represent that you have the legal authority to enter into this agreement
• You are responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activities under your account
• You agree not to share your account with others or use another person's account

2. Acceptable Use Policy

You agree not to:

• Use the App for any illegal, unauthorized, or harmful purpose
• Violate any applicable laws or regulations
• Attempt to hack, reverse-engineer, or interfere with the App
• Upload malware, viruses, or malicious code
• Harass, abuse, or threaten other users
• Create multiple accounts to circumvent restrictions or manipulate the service
• Sell, trade, or transfer your account or data
• Modify or remove copyright, trademark, or other legal notices
• Access the App through unauthorized third-party tools or bots

3. Health & Fitness Disclaimer

• Not Medical Advice: Information in Forma — including AI Coach responses — is for personal fitness tracking only and does not constitute medical advice, diagnosis, or treatment
• Consult Professionals: Before starting any fitness, diet, or exercise program, consult a doctor, registered dietitian, or qualified fitness professional
• Your Responsibility: You are solely responsible for your health decisions and the safety of your workouts and diet
• No Liability: We are not liable for any health issues, injuries, or adverse effects resulting from your use of Forma or any AI-generated coaching content
• Accuracy: Food data comes from third-party sources and may contain inaccuracies. Always verify nutritional information with authoritative sources

3a. AI Coach — Specific Disclaimers

• AI-generated content: Coaching briefs and chat responses are generated by Google Gemini and may be inaccurate, incomplete, or not suited to your individual circumstances
• No clinical relationship: Using the AI Coach does not create a relationship between you and any healthcare professional, dietitian, or certified personal trainer
• Eating disorders & medical conditions: Do not use the AI Coach if you have or suspect an eating disorder, are recovering from injury, or have a condition requiring medical supervision. Seek qualified professional help instead
• Usage limits: The AI Coach is subject to fair-use limits (currently 50 messages per week per user). Limits may change; we will notify users of material changes
• Service availability: The AI Coach is a Pro feature and may be temporarily unavailable due to capacity constraints. Rate-limiting (HTTP 429) may apply during peak usage

3b. Exercise Tutorial Links

Forma may provide external links to YouTube search results to help users find exercise form tutorials. These links open outside the Forma app. Forma does not host, download, embed, reproduce, or control any YouTube videos or third-party exercise content.

All videos, thumbnails, titles, channels, comments, recommendations, and related content shown on YouTube are provided by YouTube and/or their respective creators. Forma is not responsible for the availability, accuracy, safety, legality, quality, or content of third-party videos.

Users are responsible for evaluating whether any exercise tutorial is appropriate for their fitness level, health condition, and goals. Exercise involves risk of injury. Users should stop if they feel pain or discomfort and consult a qualified professional when needed.

YouTube and related trademarks belong to their respective owners. Forma is not affiliated with, endorsed by, or sponsored by YouTube or Google.

4. Intellectual Property Rights

• Forma IP: All content, code, logos, designs, and features of Forma are owned by or licensed to Forma and protected by copyright and trademark law
• Your Content: You retain ownership of workout and nutrition data you create
• License Grant: By using Forma, you grant us a license to process, store, and display your data to provide the service
• No Copying: You may not copy, modify, distribute, or reproduce any part of Forma without permission

5. Third-Party Services & APIs

Forma integrates with third-party services:

• RevenueCat: Subscription and billing (see RevenueCat Terms)
• Google OAuth: Account authentication (see Google Terms)
• Google Gemini (AI): AI Coach feature — fitness and nutrition data is processed by Google Gemini to generate coaching responses (see Gemini API Terms). By using the AI Coach, you agree to Google's Gemini API terms as they apply to end users of applications built on the API
• YouTube: External search result links for exercise form tutorials. Forma does not host, download, embed, reproduce, or control YouTube videos or third-party exercise content.
• HealthKit / Health Connect: Health data access (see Apple and Google privacy policies)
• Open Food Facts: Food database (see Open Food Facts)

These services have their own terms and privacy policies. We are not responsible for their content, policies, or practices.

6. Subscriptions & Billing

Free vs. Pro

• Free Tier: Basic workout and nutrition logging
• Forma Pro: Unlimited features (paid subscription)
• Trial: 7-day free trial for new Pro subscribers (where available)

Paid Subscriptions

• Subscriptions auto-renew unless canceled before the renewal date
• Billing is processed through RevenueCat and your chosen payment provider
• You authorize automatic recurring charges to your payment method
• Prices may change; we will notify you of material changes
• Canceling your subscription stops future charges but does not refund previous payments
• You can manage or cancel your subscription through your App Store account (iOS) or Google Play Store account (Android)

7. Warranty Disclaimer

We disclaim all warranties, express or implied, including:

• Merchantability, fitness for a particular purpose, non-infringement
• That the App will be uninterrupted, error-free, secure, or meet your expectations
• That defects will be corrected or that the App is virus-free

8. Limitation of Liability

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, revenue, profits, or business opportunities
• Injuries, health issues, or adverse effects from using the App or following fitness/nutrition advice
• Third-party services, links, or content accessed through Forma
• Any damages exceeding the total amount paid for the subscription in the past 12 months

9. Indemnification

You agree to indemnify, defend, and hold harmless Forma from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your use of the App in violation of law
• Your data or content submitted to Forma
• Your infringement of third-party intellectual property rights

10. Termination

• You may terminate your account anytime by contacting support@trainwithforma.app or via Settings → Delete Account
• We may terminate your account if you violate these Terms or misuse the service
• Upon termination, your right to use Forma ceases immediately
• Data deletion may take up to 30 days to process fully

11. Suspension & Account Closure

We may suspend or close your account without notice if:

• You violate these Terms or our Acceptable Use Policy
• You engage in fraudulent, abusive, or illegal activity
• We detect security threats or unauthorized access
• You fail to pay for a subscription

12. Modification of Service

• We may modify, update, or discontinue features at any time
• We will notify you of material changes via email or in-app notification
• Continued use of Forma indicates acceptance of changes

13. Privacy & Data Protection

Your use of Forma is governed by our Privacy Policy. By using the App, you consent to our collection and processing of personal and health data as described in the Privacy Policy.

14. Dispute Resolution & Governing Law

• These Terms are governed by the laws of the jurisdiction where you reside (or, if not specified, the jurisdiction of the service provider)
• Any disputes arising from these Terms shall be resolved through binding arbitration or small claims court where applicable
• You agree not to pursue class action or representative claims against Forma

16. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Forma regarding your use of the App. If any provision is found invalid, the remaining provisions remain in effect.

These Terms of Service are effective as of May 2026 and apply to all users of the Forma application across iOS and Android platforms.
